What is a Change in Ownership?

    Change in ownership is when you as an owner wish to remove a name from your contract or add a name to your contract, but you remain as an owner on the contract as well. The contract number does NOT change.

Does the timeshare automatically go to my name only if a co-owner on my contract passes away?

    No. That is why it’s in your best interest for all the owners that signed your original contract, to fill out a Beneficiary Form.

What papers do I need to send to you to have the timeshare put in my name only, if my co-owner passed away?


    Change in Ownership request to remove the name of the deceased.

    Certified copy of death certificate or original death certificate.

    Copy of will of deceased appointing heir/beneficiary OR copy of letter of administration appointing executor (rix), OR “Declaration Of Sole Ownership” signed and notarized by the surviving owner. (Form available at the Members Relations Department)

    Owner’s ID card of deceased should be returned to us.

    Cashier’s check (official Bank check) made payable to: La Cabana Beach & Racquet Club or credit card authorization for US$ 150.00 per new share certificate to be issued. You can fill out a Transfer Fee Payment to make your payment.

NOTE: Personal checks, Company Checks or Money Orders are NOT accepted.

If I want to change my last name due to divorce or marriage, what do I send to you?

    To change your name we need a legal back up, which could be either the divorce decree that states that you may resume your maiden name or a copy of your marriage license that shows that your last name has been changed. There is a non-refundable charge of US$ 150.00 to process this change and issue a new Share Certificate reflecting this change and you need to return the original Share Certificate to us.

If I got divorced and want to remove the name of my spouse, how do I go about doing that?

    You need to fill out the Change in Ownership request form( Please print – do Not write), have it signed and individually notarized by your spouse and yourself. Your spouse needs to agree to have his/her name removed from the membership.

    The original share certificate and the membership card of your spouse needs to be returned to us.

    There is a non-refundable charge of US$ 150.00 per new share certificate to be issued. This fee can only be paid by credit card or cashier’s check.

What do I do if I don’t have the original share certificate?

    Print out the “Affidavit For Lost Share Certificate”, fill it out, sign it and have your signature notarized. We must receive the original Affidavit. This signed and notarized Affidavit will allow us to process the change in ownership without the actual Share Certificate. Please note that by filling out an Affidavit your lost share certificate will not be replaced. We will issue a new share certificate for the change in ownership that you are requesting.

What do I do if I need copies of my original paperwork?

    You can request copies by sending your signed Request For Copies to us by mail or fax with your credit card authorization to charge the total amount of copies needed. The charge per copy is US$5.00. This charge is to cover additional costs and labor time.

How long does it take to process the Change in Ownership request?

    If we receive all the necessary documents, the transfer will take place within two weeks of receipt. The new share certificate takes about two months to be ready, and will be mailed by registered mail.

What is the best way to mail the paperwork?

    Federal Express, UPS, or EXPRESS MAIL. These mailing services are the fastest and offer you the possibility to track your mail online. This way there is no need to contact us to inquire if the paperwork has been received.

    Please do not mail the paperwork by registered mail, certified mail or regular mail since these take at least 4 weeks to be delivered to us and you are not able to track it.
